Child Care within a Residence

Applying for Zoning Approval:
Submit in person the following information to the Zoning Administration Office at 5 County Complex Court, Suite 180, Prince William, Virginia, 22192.
Home Occupancy Certificate - Family Day Homes:
  • Completed HOC-2 Family Day Home Application. Initial applications are to be submitted in person (faxed or applications sent by mail are not accepted).   
    *For a Family Day Home allowed pursuant to a Special Use Permit, the application for Zoning Approval shall be submitted after approval of the Special Use Permit.
  • Bring cash, check, credit/debit card, or money order for the amount of the appropriate Fee.
  • Provide proof of current residence through a valid government issued identification card (such as a valid driver's license or DMV identification card) or through other proofs of residency that include deeds, leases, and utility bills. Cell phone bills, letters, and an expired driver's license does not count.
  • Provide a copy of your current Infant and Child or Pediatric Cardio-Pulmonary Resuscitation (CPR) Certificate, from an approved certification center (Internet certificates are not accepted).  
  • Prior to approval by the Zoning Administrator, notification shall be sent by certified mail to the last known address of each adjacent property owner. If the Zoning Administrator receives no written objection from a person so notified within thirty (30) days of the date of sending the letter and determines that the Family Day Home otherwise complies with the provisions of the Ordinance the Zoning Administrator may issue a permit for the Family Day Home. An applicant who is denied a permit through the aforesaid administrative process may request a hearing before the Board of County Supervisors following public notice as provided in Section 15.2-2204, VA Code Ann.
    • A Certificate of Occupancy through Building Development with the paid fee. The process to receive the Certificate of Occupancy begins through the submission of the HOC2 - Family Day Home through the Zoning Administration.  
    • State of Virginia Certification (Once received, a copy is to be submitted to Zoning Administration).

Family Day Home: The secondary use of a dwelling unit as set for in subsections 32-300.02.15(a) through (d), and as defined in Section 63.2-100 VA Code Ann, to provide care during only a part of the twenty four (24) hour day for one through twelve children under the age of 13, when at least one child receives care for compensation, exclusive of the provider's own children and any children who reside in the home, meaning those related by blood, adoption or marriage to the provider who maintains the home, and those in foster care with the provider, or in the provider's permanent custody or already residing in the provider's dwelling, and which may employ at any one time not more than two (2) persons not residing in the home, provided that such person shall be at least fourteen (14) years of age and shall be certified or otherwise meet the appropriate social service regulatory agency's approval. The term "family day home" is not intended to include babysitting services of a casual, irregular nature in or outside of the child's own home. It is also not intended to include cooperative, reciprocal child care by a group of parents in their respective residences, subject to meeting the following standards.


Please note:

  • Family Day Care businesses are subject to the provisions of Sec. 32-300.02 (15) of the Prince William County Zoning Ordinance (conditions/restrictions are also listed on the HOC2 application form).
  • Two non-resident employees (CPR certified) are allowed (contact Social Services at 703-792-7500 for age-limit restrictions).
  • Renewal of zoning approval for a Family Day Home (HOC-2) is no longer required as long as the conditions under the initial approval remains the same. Should any conditions change, such as maximum number of children, number of assistants, address change, etc., a new zoning permit will be required.
  • If the business is transferred to a new location, a new zoning approval and a new occupancy permit must be obtained for the new location.
  • The maximum number of children allowed does not include the applicant’s own children.
