The Circuit Court Clerk's Civil Office (Room 314) handles divorce suits.
General Information

To obtain a divorce in Virginia, you or your spouse must be a resident of Virginia for a minimum of six months prior to filing for a divorce, Virginia Code § 20.97. |

If there are no children from the marriage, you must be separated for a minimum of six months and have a written property settlement agreement before you file for a divorce, Virginia Code § 20.91. |

If there are children from the marriage, you must be separated a minimum of one year before you file for a divorce, Virginia Code § 20.91. |

In Virginia, Separation Agreements are filed only AFTER a divorce case has been filed with the Court. |

Note: A completed State Vital Statistics VS-4 form, revised July 2004, must be filed with the Final Order of Divorce. The VS-4 form is available in the Clerk’s Office. All information must put on the original form and must be typed or printed in black ink only.

Copies of Orders and Pleadings
A copy of the final decree of divorce will be sent to each of the attorneys for the parties after the judge signs it. Additional copies of decrees or copies of pleadings may be requested in person or in writing.
The fee for copies is 50¢ per page. There is an additional $2.00 fee for certifying a copy of a document. Requests for copies sent by mail must be accompanied by check or money order covering the cost of the copies. Checks should be made payable to "Prince William County Circuit Court Clerk."
